1. Acceptance of Terms

These Terms of Service (“Terms”) are effective as of March 23, 2026 and govern your access to and use of Resume Genie (“Service,” “we,” “us,” or “our”). By creating an account, accessing, or otherwise using the Service, you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

You must be at least sixteen (16) years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

If you do not agree to these Terms, you must immediately cease all use of the Service and delete your account.

2. Service Description

Resume Genie is a software-as-a-service (“SaaS”) platform that provides AI-assisted resume and cover letter creation, editing, PDF generation, and applicant tracking system (“ATS”) scoring tools. The Service leverages artificial intelligence to offer content suggestions, keyword analysis, resume tailoring, and related career-document features.

We reserve the right to modify, enhance, or discontinue any feature of the Service at any time, with or without notice, subject to applicable subscription obligations.

3. Your Account

You are responsible for maintaining the confidentiality and security of your account credentials, including your password and any authentication tokens. You agree to notify us immediately at support@getresumegenie.com if you suspect any unauthorized access to or use of your account.

Accounts are for individual use only — one account per person. You may not share, sell, resell, transfer, or sublicense your account or access credentials to any third party. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate.

You are solely responsible for all activity that occurs under your account, whether or not you authorized such activity. We shall not be liable for any loss or damage arising from your failure to safeguard your credentials.

4. Subscriptions and Billing

Resume Genie offers free and paid subscription plans on monthly and annual billing cycles. Paid plans automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing to a paid plan, you authorize us to charge the applicable fees to your designated payment method on a recurring basis.

We reserve the right to change subscription pricing at any time. We will provide at least thirty (30) days' prior notice of any price increase. The new price will take effect at the start of your next billing period following the notice period.

Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date. If you downgrade your plan, your existing content will be preserved; however, access to certain features may be limited based on the capabilities of your new plan tier.

Refund requests are evaluated on a case-by-case basis and must be submitted within seven (7) days of the charge in question by contacting support@getresumegenie.com. We are under no obligation to grant refunds except where required by applicable law.

5. Your Content

You retain all ownership rights in the content you create, upload, or input into the Service (“Your Content”). Resume Genie does not claim ownership of Your Content.

By using the Service, you grant Resume Genie a limited, non-exclusive, royalty-free, worldwide license to use, store, reproduce, process, and transmit Your Content solely for the purpose of providing the Service to you. This includes transmitting Your Content to third-party AI providers (such as OpenAI) for the purpose of generating AI-powered suggestions, analysis, and other features you request.

This license terminates upon deletion of the applicable content or upon deletion of your account, subject to reasonable backup retention periods and third-party service retention policies as described in Section 15.

6. Acceptable Use

You agree not to use the Service to:

  • Engage in any activity that violates applicable local, state, national, or international law or regulation;
  • Access, tamper with, or use non-public areas of the Service, other users' accounts, or other users' data;
  • Circumvent, disable, or otherwise interfere with usage limits, rate limits, or security-related features of the Service;
  • Create, upload, or distribute resume or cover letter content that you know to be materially false, fraudulent, or misleading;
  • Use automated scripts, bots, crawlers, scrapers, or similar means to access or interact with the Service;
  • Upload or transmit content that infringes upon the intellectual property rights of any third party;
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Service.

We reserve the right to investigate and take appropriate action, including suspension or termination of your account, for any violation of these restrictions.

7. AI-Generated Content Disclaimer

The Service utilizes artificial intelligence to provide content suggestions, resume scoring, keyword analysis, and other automated outputs (“AI-Generated Content”). AI-Generated Content is provided as suggestions only and may contain inaccuracies, errors, or omissions. You are solely responsible for reviewing, editing, verifying, and approving all AI-Generated Content before use.

Resume Genie makes no guarantee whatsoever regarding job outcomes, including but not limited to job interviews, job offers, ATS pass rates, ATS scores, or career advancement. ATS scores provided by the Service are estimates based on heuristic and AI-powered analysis and do not reflect the actual scoring methodology of any specific employer or applicant tracking system.

The Service does not constitute professional career advice, employment counseling, or recruiting services. You should exercise your own independent judgment and, where appropriate, seek professional advice before relying on any AI-Generated Content.

8. Third-Party Services

The Service integrates with and relies upon the following third-party services:

  • OpenAI — AI-powered content generation, analysis, and scoring features;
  • Stripe — Payment processing and subscription billing;
  • Supabase — Data storage, database hosting, and authentication;
  • Resend — Transactional email delivery;
  • Google Fonts — Font rendering for PDF generation.

Each third-party service is governed by its own terms of service and privacy policy. Your use of features that rely on these services is also subject to their respective terms.

Resume Genie is not liable for any outages, data loss, policy changes, service degradation, or other actions or omissions of third-party service providers. We do not control and are not responsible for the content, privacy practices, or security measures of any third-party service.

9. Warranty Disclaimer

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, statutory, or otherwise. Resume Genie expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, Resume Genie does not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the results obtained from the Service, including AI-generated content and ATS scores, will be accurate, reliable, or complete; (c) any errors in the Service will be corrected; or (d) the Service or the servers that make it available are free of viruses, malware, or other harmful components.

You acknowledge that you use the Service at your sole risk. No advice or information, whether oral or written, obtained from Resume Genie or through the Service shall create any warranty not expressly made herein.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Resume Genie, its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of business opportunities, loss of goodwill, or costs of procurement of substitute services, arising out of or in connection with your access to or use of (or inability to access or use) the Service, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if Resume Genie has been advised of the possibility of such damages.

In no event shall the aggregate liability of Resume Genie for all claims arising out of or relating to these Terms or the Service exceed the greater of: (a) the total amounts paid by you to Resume Genie during the twelve (12) months immediately preceding the event giving rise to the claim; or (b) one hundred United States dollars (US $100.00).

The limitations set forth in this section shall apply regardless of the form of action or theory of liability, whether in contract, tort (including negligence), strict liability, or otherwise, and shall survive any failure of essential purpose of any limited remedy.

11. Indemnification

You agree to defend, indemnify, and hold harmless Resume Genie, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your Content, including any content you create, upload, or generate through the Service;
  • Your violation of these Terms or any applicable law or regulation;
  • Your violation or alleged violation of any third-party rights, including intellectual property, privacy, or publicity rights;
  • Any content created, uploaded, or generated through the Service using your account.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you agree to cooperate with us in asserting any available defenses.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois without regard to its conflict of law principles.

Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve the dispute informally by contacting us at support@getresumegenie.com. We will attempt to resolve the dispute informally within thirty (30) days. If the dispute is not resolved within that period, either party may proceed as set forth below.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) in accordance with its then-current arbitration rules. The arbitration shall be conducted in the English language. Judgment on the arbitration award may be entered in any court of competent jurisdiction. Notwithstanding the foregoing, either party may seek relief in a small claims court of competent jurisdiction for disputes within that court's jurisdictional limits.

Class action waiver: All proceedings to resolve disputes shall be conducted on an individual basis only. You waive any right to participate in a class action, collective action, private attorney general action, or any other representative proceeding. You also waive any right to a jury trial. Unless both you and Resume Genie agree otherwise, the arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

13. DMCA / Copyright

Resume Genie respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond promptly to claims of copyright infringement committed using the Service.

If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement, please submit a written notification to our designated DMCA agent at support@getresumegenie.com containing the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material;
  4. Your contact information, including your address, telephone number, and email address;
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

If you believe that content you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent containing: (a) your physical or electronic signature; (b) identification of the removed material and its prior location; (c) a statement under penalty of perjury that you have a good faith belief the material was removed by mistake; and (d) your name, address, telephone number, and consent to the jurisdiction of federal district court in your judicial district.

14. Electronic Communications

By creating an account, you consent to receive electronic communications from Resume Genie, including but not limited to service announcements, billing notifications, administrative messages, and updates related to your account or the Service. These communications may be sent via email or displayed within the Service.

You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You further agree that electronic records of such communications shall be deemed to satisfy any requirement for a written record.

15. Account Termination

We reserve the right to suspend or terminate your account and access to the Service, without prior notice or liability, for any conduct that we, in our sole discretion, determine violates these Terms, is harmful to other users or the Service, or is otherwise objectionable.

You may delete your account at any time through the Settings page in the Service. Upon account deletion, we will delete your data from our active systems. Residual copies may persist in encrypted backups for a limited period consistent with our backup retention schedule. Data previously transmitted to third-party services (such as our payment processor or AI providers) is subject to those services' respective data retention policies and is outside our direct control.

Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

16. Force Majeure

Resume Genie shall not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond our reasonable control, including but not limited to: acts of God; natural disasters; earthquakes, floods, fires, or severe weather events; war, armed conflict, terrorism, or civil unrest; epidemics, pandemics, or public health emergencies; government actions, sanctions, embargoes, or regulatory changes; power outages; internet or telecommunications infrastructure failures; denial-of-service attacks or other cyberattacks; or failures of third-party service providers upon which the Service relies.

17. Feedback

If you provide Resume Genie with any feedback, suggestions, ideas, improvements, enhancement requests, or other recommendations regarding the Service (“Feedback”), you acknowledge and agree that such Feedback is non-confidential and that Resume Genie is granted an irrevocable, non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, create derivative works from, distribute, and display such Feedback in any manner and for any purpose without any obligation, compensation, or attribution to you.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Resume Genie with respect to the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Service.

20. Assignment

Resume Genie may assign or transfer these Terms, in whole or in part, without restriction and without your consent, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets. You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. Any purported assignment in violation of this section shall be null and void.

21. Survival

The following provisions shall survive the expiration or termination of these Terms for any reason: Warranty Disclaimer (Section 9), Limitation of Liability (Section 10), Indemnification (Section 11), Governing Law and Dispute Resolution (Section 12), DMCA / Copyright (Section 13), Your Content (Section 5, to the extent of the license grant), Feedback (Section 17), and any other provisions that by their nature are intended to survive termination.

22. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least thirty (30) days' advance notice before the revised Terms become effective, via email to the address associated with your account or through a prominent notice within the Service.

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account before the effective date.

Changes to these Terms are not retroactive and shall not apply to any dispute of which the parties had actual notice prior to the date of the change.
